Pursuant to section 451 of the District of Columbia Home Rule Act (D.C. Official Code § 1-
204.51) and section 202 of the Procurement Practices Reform Act of 2010 (D.C. Official Code §
2-352.02), enclosed for consideration and approval by the Council of the District of Columbia is
proposed Modification No. M00004 to Human Care Agreement No. CW73127 (DCJM-2019-H-
0001-14) with RCM of Washington, Inc., to exercise option year four in the not-to-exceed amount
of $1,043,825.43. The period of performance is from October 1, 2023 through September 30,
2024.
Under the proposed modification, RCM of Washington, Inc. shall continue to provide residential
expenses and services not covered by Medicaid for individuals with intellectual and developmental
disabilities.

in the District's Local Budget and Financial Plan for Fiscal Year 2024 to fund the costs associated
with the Department on Disability Services HCA with RCM of Washington. This certification
supports the Residential Habilitation, Supported Living, and Host Home Occupancy Related
Residential Expenses for District of Columbia Persons with Intellectual and Developmental
Disabilities (Residential Expenses) contract during the period from October 1, 2023, through

A. The Government of the District of Columbia hereby exercises its option to extend the term of Human Care
Agreement (HCA) No. CW73127 (DCJM-2019-H-0001-14), pursuant to Section F.3, Option to Extend Term
of the Agreement, for option year four (OY4) October 1, 2023 through September 30, 2024.
B. The not-to-exceed HCA amount of OY4 is $1,043,825.43.
C. On July 1, 2023, the Living Wage and the Minimum Wage Rates will increase to $17.00 per hour. The revised
Living Wage Act Notice and Fact Sheet effective July 1, 2023 have been posted on the OCP internet under
“Required Solicitation Documents.”
D. Replace the U.S. Department of Labor Wage Determination No. 2015-4281, Revision No.21, dated
12/27/2021, hereby incorporated into this contract, with the U.S. Department of Labor Wage Determination

B.10 DESIGNATION OF SOLICITATION FOR THE SMALL BUSINESS SET-ASIDE
MARKET ONLY
B.10.1 NONPROFIT FAIR COMPENSATION ACT OF 2020, D.C. Code § 2-222.01 et seq.
Nonprofit organizations, as defined in the Act, shall include in their rates the indirect costs incurred
in provision of goods or performance of services under this contract pursuant to the nonprofit
organization's unexpired Negotiated Indirect Cost Rate Agreement (NICRA). If a nonprofit
organization does not have an unexpired NICRA, the nonprofit organization may elect to instead
include in its rates its indirect costs:
(1) As calculated using a de minimis rate of 10% of all direct costs under this contract;
(2) By negotiating a new percentage indirect cost rate with the awarding agency;
(3) As calculated with the same percentage indirect cost rate as the nonprofit organization
negotiated with any District agency within the past 2 years; however, a nonprofit organization
may request to renegotiate indirect costs rates in accordance with B.11.2; or
(4) As calculated with a percentage rate and base amount, determined by a certified public
accountant, as defined in the Act, using the nonprofit organization's audited financial statements
from the immediately preceding fiscal year, pursuant to the OMB Uniform Guidance, and
certified in writing by the certified public accountant.
B.10.2 If this contract is funded by a federal agency, indirect costs shall be consistent with the
requirements for pass-through entities in 2 C.F.R. § 200.331, or any successor regulations.
B.10.3 The Contractor shall pay its subcontractors which are nonprofit organizations the same
indirect cost rates as the nonprofit organization subcontractors would have received as a prime
contractor.
F. Insert Section I.17 SPECIAL PROVISION RELATED TO CITY ADMINISTRATOR’S ORDER 2022-3
Contractors who provide goods or perform services in person in District of Columbia facilities or worksites
(“On-site Contractors”) shall ensure that each of their employees, agents, subcontractors, and supervised
volunteers comply with City Administrator’s Order 2022-3, Mask Requirements Inside Certain District
Government Buildings and Offices, dated April 14, 2022, and all substantially similar mask requirements
including any modifications to the Order, unless and until they are rescinded.
All other terms and conditions remain the same.
