To declare the existence of an emergency with respect to the need to approve Contract No.

       CW106027 with Voyager Trucking Corporation to provide municipal solid waste hauling

       and disposal services to the Department of Public Works, and to authorize payment for

       the goods and services received and to be received under the contract.

        RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this

resolution may be cited as the “Contract No. CW106027 with Voyager Trucking Corporation

Approval and Payment Authorization Emergency Declaration Resolution of 2023”.

        Sec. 2. (a) There exists an immediate need to approve Contract No. CW106027 with

Voyager Trucking Corporation to provide municipal solid waste hauling and disposal services to

the Department of Public Works and to authorize payment for the goods and services received

and to be received under the contract.

        (b) On February 16, 2023, the Office of Contracting and Procurement (“OCP”), on

behalf of the Department of Public Works (“DPW”), entered into Letter Contract No.

CW106027 with Voyager Trucking Corporation to provide municipal solid waste hauling and

disposal services for 60 days, in the not-to-exceed amount of $1,000,000.

        (c) By Modification No. 1, dated March 14, 2023, OCP, on behalf of DPW, extended the

term of Letter Contract No. CW106027 from April 17, 2023 to June 30, 2023, at no cost to the

District.

        (d) Modification No. 2 was an administrative modification.

        (e) By Modification No. 3, dated June 22, 2023, OCP, on behalf of DPW, extended the

term of Letter Contract No. CW106027 from June 30, 2023 to September 30, 2023, in the not-to-

exceed amount of $1,500,000, thereby increasing the total not-to-exceed amount to $2,500,000

for the period February 16, 2023, through September 30, 2023.

        (f) Council approval is required by section 451(b) of the District of Columbia Home

Rule Act, approved December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51(b)) because

the value of the contract is more than $1 million during a 12-month period.

        (g) Council approval is also required to approve Contract No. CW106027 in the not-to-

exceed amount of $15,709,910 for the period from March 1, 2023, through February 28, 2025.

        (h) Approval is necessary to allow the continuation of these vital services.

         Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute

emergency circumstances making it necessary that the Contract No. CW106027 with Voyager

Trucking Corporation Approval and Payment Authorization Emergency Act of 2023 be adopted

after a single reading.

       Sec. 4. This resolution shall take effect immediately.
