To declare the existence of an emergency with respect to the need to approve Modification Nos.

       3, 5, and 8, and proposed Modification No. 10 to Contract No. DCAM-21-CS-IFB-0002,

       between the Department of General Services and Consys, Inc. to provide construction

       services for the new W Street, NE bus terminal for the Office of the State Superintendent

       of Education’s Division of Student Transportation, increasing the aggregated not-to-

       exceed amount by $3,771,505.81 from $16,809,610.00 to $20,581,115.81, and to

       authorize payment to Consys, Inc. for services received and to be received under these

       modifications.

        RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this

resolution may be cited as “Modification Nos. 3, 5, 8 and 10 to Contract No. DCAM-21-CS-IFB-

0002 with Consys, Inc. Approval and Payment Authorization Emergency Declaration Resolution

of 2023”.

        Sec. 2 (a) There exists an immediate need to approve Modification Nos. 3, 5, 8, and 10 to

Contract No. DCAM-21-CS-IFB-0002, with Consys, Inc. to provide construction services for the

new W Street, NE bus terminal for the Office of the State Superintendent of Education’s

Division of Student Transportation and to authorize payment for services received and to be

received under these modifications.

        (b) On July 21, 2022, Contract No. DCAM-21-CS-IFB-0002 was executed for a not-to-

exceed amount of $16,809,610.00.

        (c) Modification No. 3 increased the not-to-exceed amount of the Contract by

$190,927.76, from $16,809,610 to $17,000,537.76.

        (c) Modification No. 5 increased the not-to-exceed amount of the Contract by

$298,462.62, from $17,000,537.76 to $17,299,000.38.

        (c) Modification No. 8 increased the not-to-exceed amount of the Contract by

$484,701.53, from $17,299,000.38 to $17,783,701.91.

        (d) Proposed Modification No. 10 will increase the not-to-exceed amount by

$2,797,413.90, from $17,783,701.91 to $20,581,115.81. The aggregate value of Modification

Nos. 3, 5, 8, and proposed Modification No. 10 is $3,771,505.81, an amount over $1 million;

therefore, Council approval of the Contract No. DCAM-21-CS-IFB-0002 and the modifications

is required pursuant to section 451 of the District of Columbia Home Rule Act, approved

December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51).

       Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute

emergency circumstances making it necessary that the Modification Nos. 3, 5, 8 and 10 to

Contract No. DCAM-21-CS-IFB-0002 with Consys, Inc. Approval and Payment Authorization

Emergency Act of 2023 be adopted after a single reading.

       Sec. 4. This resolution shall take effect immediately.
