IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

To declare the existence of an emergency with respect to the need to approve Contract No.
CW101161 and modifications thereto with Maxim Healthcare Staffing Services, Inc. for
COVID-19 positive case response and immunization support services for students who
attend District public charter schools, and to authorize payment for goods and services
received under the contract.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “Contract No. CW101161 with Maxim Healthcare Staffing
Services, Inc. Approval and Payment Authorization Emergency Declaration Resolution of
2023”.
Sec. 2. (a) There exists a need to approve Contract No. CW101161 and modifications
thereto with Maxim Healthcare Staffing Services, Inc. for COVID-19 positive case response and
immunization support services for students who attend DC public charter schools and to
authorize payment for the goods and services received under the contract and modifications.
(b) On August 2, 2022, the Office of Contracting and Procurement, on behalf of the
Office of the State Superintendent of Education, entered into Contract No. CW101161 for the
period from August 3, 2022 through August 2, 2023, in the not-to-exceed amount of
$13,253,400.
(c) Modification No. 1, dated August 4, 2022, corrected the period of performance to
from August 2, 2022 through August 1, 2023.
(d) Modification No. 2, dated September 13, 2022, decreased the not-to-exceed amount
for Contract No. CW101161 to $10,269,900.
(e) Council approval is required by section 451(b) of the District of Columbia Home
Rule Act, approved December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51(b)),
because the contract is for more than $1 million during a 12-month period.
(f) Without Council approval, Maxim Healthcare Staffing Services, Inc. cannot be paid
for goods and services provided in excess of $1 million for the period from August 2, 2022
through August 1, 2023.

Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute
emergency circumstances making it necessary that the Contract No. CW101161 with Maxim
Healthcare Staffing Services, Inc. Approval and Payment Authorization Emergency Act of 2023
be adopted after a single reading.
Sec. 4. This resolution shall take effect immediately.
