To declare the existence of an emergency, due to congressional review, with respect to the need
to designate Good Hope Road, SE, between Anacostia Drive, SE, and Alabama Avenue,
SE, as Marion Barry Avenue, SE; to symbolically designate Marion Barry Avenue, SE,
between the intersection of Naylor Road, SE, and 25th Street, SE, and Alabama Avenue,
SE, as Good Hope Way; and to require the District to reissue certain documents to
individuals and entities with new addresses on Marion Barry Avenue, SE.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “Marion Barry Avenue Designation Congressional Review
Emergency Declaration Resolution of 2023”.
Sec. 2. (a) On May 2, 2023, the Council adopted the Marion Barry Avenue Designation
Emergency Act of 2023, effective May 24, 2023 (D.C. Act 25-112; 69 DCR 7938) (“Emergency
Act”), which expires on August 22, 2023.
(b) Previously, the Council enacted substantially similar permanent legislation, the
Marion Barry Avenue Designation Act of 2023, enacted on April 26, 2023 (D.C. Act 25-81; 70
DCR 6321) (“Permanent Act”), which is pending congressional review. The Permanent Act has
an applicability date of July 1, 2023.
(c) Emergency legislation is necessary to prevent a gap in the law between the expiration
of the Emergency Act and the effective date of the Permanent Act.
Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute
emergency circumstances making it necessary that the Marion Barry Avenue Designation
Congressional Review Emergency Act of 2023 be adopted after a single reading.
Sec. 4. This resolution shall take effect immediately.
