Pursuant to D.C. Official Code § 2-352.02(a), enclosed for consideration and approval by
the Council of the District of Columbia is the exercise of Option Year Four of the above
referenced contract with Siemens Industry, Inc. The proposed period of performance is
from October 1, 2023 to September 30, 2024. The dollar value of the proposed Option
Year Four is a not-to-exceed amount of $1,385,800.
The purpose of this contract is to provide switchgear testing, inspection, maintenance,
and repair at the Walter E. Washington Convention Center and the Entertainment and
Sports Arena. A full Contract Option Year Summary is provided.

GSA Task Order AGR-190110001916 was awarded to Siemens in October 2019 for
Siemens to provide high-and-low-voltage switchgear inspection and testing, substation
maintenance and testing, load bank testing, and on-call repair and maintenance services at
the Walter E. Washington Convention Center and the Entertainment and Sports Arena. The
primary purpose of the switchgear equipment is to control the flow of electrical current to
protect the facility from electrical damage as the result of ground faults, outages, excess
currents, or other irregularities at fixed hourly rates. The price for the Base Term and option
years is set forth below:

Siemens is current with its tax obligations. See Tab 3
(D) A certification that the proposed Contract is within the appropriated budget
authority for the agency for the fiscal year and is consistent with the financial plan
and budget adopted in accordance with §§ 47-392.01 and 47-392.02.
Events DC’s budget is separate from the financial plan and budget adopted by the District
of Columbia in accordance with D.C. Official Code §§ 47-392.01 and 47-392.02. Pursuant
to Public Law No. 105-227, Congress has exempted Events DC from the appropriation
requirement set forth in Section 446 of the Home Rule Act (Public Law No 105-227, 1122
Stat. 1515 (August 12, 1998). Events DC’s Fiscal Year 2024 budget was adopted by its
Board of Directors on March 9, 2023. By signature below, Events DC’s Chief Financial
Officer certifies that funding for Option Year Four of the Contract is consistent with Events
DC’s approved Fiscal Year 2024 budget.

I. Description of Proposed Option Year
Events DC proposes to exercise Option Year Four of Contract No. AGR-190110001916
(“Contract”) with Siemens Industry, Inc. (“Siemens”) to provide Switchgear
Maintenance, Inspection, Testing and Repair Services at the Walter E. Washington
Convention Center and the Entertainment and Sports Arena.
II. Procurement Overview
The Contracting Officer has determined that: (i) the exercise of Option Year Four of the
Contract is in the best interest of Events DC; (ii) the total amount for Option Year Four of
the Contract is not-to-exceed $1,385,800 and (iii) the requirements covered by the
Contract fulfill an existing need for Events DC. Based on the foregoing, the Chief
Contracting Officer proposes to exercise Option Year Four of the Contract.
III. Legal Review
The Office of General Counsel has reviewed the proposed Option Year Four Contract
modification and finds it to be legally sufficient.

APPROVAL OF FUNDING FOR OPTION YEAR FOUROF GSA TASK ORDER AGREEMENT
WITH SIEMENS INDUSTRY, INC. FOR SWITCHGEAR INSPECTION, TESTING,
MAINTENANCE AND REPAIR SERVICES
WHEREAS, in October 2019, the Washington Convention and Sports Authority
(“Authority”) entered into a General Services Administration Supply Schedule Task Order
Agreement with Siemens Industry, Inc. (“Siemens”), comprising a base term of one (1) year and
four (4), one-year options (the “Contract”) to provide inspection, testing, maintenance and repairs
to the switchgear systems at the Walter E. Washington Convention Center (“Convention Center”)
and the Entertainment and Sports Arena, with the Contract’s base term funded at a not-to-exceed
(“NTE”) amount of $425,000; and
WHEREAS, in 2020, 2021 and 2022, the Authority exercised Option Years One, Two and
Three of the Contract at the respective NTE amounts of $250,000, $300,000 and $488,288; and
WHEREAS, during Option Year Four, Siemens will continue its general inspection, testing,
maintenance and repair work for the switchgear systems and will also begin working on a project
to replace the obsolete circuit breakers at the Convention Center, at the NTE price of $1,385,800;
and
WHEREAS, the President and Chief Executive Officer, in her capacity as Chief Contracting
Officer, and the Operations Committee of the Board of Directors have recommended approval of
the expenditure of funds for Option Year Four of the Contract; and
WHEREAS, funding for the exercise of Option Year Four of the Contract is available in
the Authority’s approved fiscal year 2024 operating and capital budgets.
NOW, THEREFORE, BE IT RESOLVED THAT, the Board of Directors accepts the
recommendation of the President and Chief Executive Officer and the Operations Committee and
approves the expenditure of funds for Option Year Four of the Contract with Siemens Industry,
Inc. in the not-to-exceed amount of $1,385,800, subject to the approval of the Council of the District
of Columbia (“Council”) in accordance with D.C. Code § 1-204.51.
AND BE IT FURTHER RESOLVED THAT, the President and Chief Executive Officer
shall submit the agreement for the exercise of Option Year Four of the Contract to the Council
for approval as required herein.
This Resolution No. 23-12 may be executed in counterparts.
