EBA shall provide evidence based practice (EBP) models, implementation support, technical
assistance, and quality assurance to support the specialized needs of children and youth in need of
Behavioral Health Services in the District.
(G) The selection process, including the number of offerors, the evaluation criteria, and the
evaluation results, including price, technical or quality, and past performance components:
An RFP was issued on December 29, 2022, with a closing date of January 19, 2023. The contracting
officer received three proposals. The Technical Evaluation Panel and the contracting officer
evaluated the proposals in accordance with the following technical evaluation factors: Expertise of
the Firm, Methodology, Project Team, and past performance.
The contracting officer awarded a letter contract to EBA, after determining that EBA met all the
technical requirements, and their proposed price was fair and reasonable.
(H) A description of any bid protest related to the award of the contract, including whether the
protest was resolved through litigation, withdrawal of the protest by the protestor, or voluntary
corrective action by the District. Include the identity of the protestor, the grounds alleged in
the protest, and any deficiencies identified by the District as a result of the protest:

(I) The background and qualifications of the proposed contractor, including its organization,
financial stability, personnel, and performance on past or current government or private sector
contracts with requirements similar to those of the proposed contract:
EBA is an experienced contractor, providing EBP models, implementation support and technical
assistance to the District since 2013, and has been performing its responsibility satisfactorily. They
have demonstrated through past performance that its organization has the history, organizational and
technical experience, including the key personnel, required to successfully meet the requirements of
the proposed contract.
(J) A summary of the subcontracting plan required under section 2346 of the Small, Local, and
Disadvantaged Business Enterprise Development and Assistance Act of 2005, as amended, D.C.
Official Code § 2-218.01 et seq. (“Act”), including a certification that the subcontracting plan
meets the minimum requirements of the Act and the dollar volume of the portion of the contract
to be subcontracted, expressed both in total dollars and as a percentage of the total contract
amount:
The Department of Small and Local Business Development approved a partial waiver of
25% subcontracting requirement on December 7, 2022. EBA submitted a subcontracting plan
for $125,000, which is equal to the required 10%.

(K) Performance standards and the expected outcome of the proposed contract:
EBA shall provide the services outlined in section C of the contract. The expected outcome is an
improved behavioral and mental welfare of children and youth in the District receiving these services.
(L) The amount and date of any expenditure of funds by the District pursuant to the contract prior
to its submission to the Council for approval:

(M) A certification that the proposed contract is within the appropriated budget authority for the
agency for the fiscal year and is consistent with the financial plan and budget adopted in
accordance with D.C. Official Code §§ 47-392.01 and 47-392.02:
The Agency Fiscal Officer has certified that funding in the amount of $1,249,999.86 is available.
(N) A certification that the contract is legally sufficient, including whether the proposed contractor
has any pending legal claims against the District:
The Office of the Attorney General has determined that the proposed definitized contract with EBA
is legally sufficient, and that the contractor has no pending legal claims against the District.
(O) A certification that Citywide Clean Hands database indicates that the proposed contractor is
current with its District taxes. If the Citywide Clean Hands Database indicates that the
proposed contractor is not current with its District taxes, either: (1) a certification that the
contractor has worked out and is current with a payment schedule approved by the District;
or (2) a certification that the contractor will be current with its District taxes after the District
recovers any outstanding debt as provided under D.C. Official Code § 2-353.01(b):
The Clean Hands Certification dated May 22, 2023, verifies the contractor’s compliance with District
taxes.
(P) A certification from the proposed contractor that it is current with its federal taxes, or has
worked out and is current with a payment schedule approved by the federal government:
The contractor has self-certified, via Bidder-Offeror Certification form, that the contractor is
current with its federal taxes.

1. Description of Proposed Contract
The District of Columbia’s (“District”) Office of Contracting and Procurement (“OCP”) issued
Letter Contract CW106973 (the “Contract”) awarded to Evidence Based Associates (“EBA”).
OCP now seeks approval of the definitized Contract, merging with and incorporating within it,
the letter Contract. Under the Contract, EBA shall provide Evidence Based Practice models,
implementation support, technical assistance, and quality assurance to support the specialized
needs of children and youth in need of behavioral health services in the District.
The base period term is March 28, 2023, through March 27, 2024, with four option periods to
follow if exercised. OCP executed the letter Contract on March 28, 2023, with an initial term
through July 25, 2023, and in the not-to-exceed amount of $513,603.45. OCP now seeks
approval of the definitized Contract, executing the full term of March 28, 2023, through March
27, 2024, and the full fixed price contract amount of $1,249,999.86.
2. Procurement Process
A Request for Proposals (RFP) was issued on December 29, 2022, with a closing date of January
19, 2023. The Contracting Officer (CO) received three timely proposals. The Technical

Evaluation Panel and the CO evaluated the proposals in accordance with the following technical
evaluation factors: Expertise of the Firm, Methodology, Project Team, and Past Performance and
Experience.
The CO determined that two of the three offerors were not technically viable to perform under
this contract. The CO determined that EBA’s technical proposal met all the technical
requirements of the RFP and contained no weaknesses or deficiencies. The CO also conducted a
price analysis of EBA’s proposal and determined their price was fair and reasonable.
Accordingly, the CO recommends an award to EBA.
EBA also does not appear on any federal or District excluded parties’ listings. The Office of the
Chief Financial Officer certified that funds are available for this Contract. On December 7, 2022,
the Department of Small and Local Business Development approved a partial waiver of the
District’s subcontracting requirement. EBA submitted a subcontracting plan for $125,000, which
is equal to the required waiver amount of 10%.
On March 28, 2023, a letter contract was awarded to EBA with a period of performance from
March 28, 2023, through July 25, 2023. The award was not protested.
3. Legal Review
By email dated June 1, 2023, you requested that this Office review for legal sufficiency the
proposed contract action. We have reviewed and approved the current contract package for legal
sufficiency.
