Dear Chairman Mendelson:
Pursuant to the Reprogramming Policy Act of 1980, D.C. Official Code § 47-363(a) and the
District of Columbia Consolidated Appropriations Act, 2023, approved December 29, 2022 (P.L.
117-328), the Office of the Chief Financial Officer (OCFO) has reviewed the Mayor’s request to
reprogram Fiscal Year 2023 Special Purpose Revenue funds budget authority in the amount of
$290,000 within the Office of the People’s Counsel (OPC). Budget authority is needed to support
office construction, language translations, education and outreach initiatives, computer upgrades,
office supplies, and IT hardware.
This reprogramming is below the $500,000 threshold amount requiring approval by Council.
However, another reprogramming from OPC has already been approved, and this reprogramming
would result in a cumulative change to the budget of OPC of more than $500,000.
This action will reprogram budget authority within the Agency Management and Office of the
People’s Counsel programs from Accounts 701100C (Continuing Full Time), 711100C (Supplies
and Materials), and 713100C (Other Services and Charges), to Accounts 703100C (Other Services
and Charges) and 717100C (Purchases Equipment and Machinery). Budget authority is available
because of projected salary lapse savings and the realignment of available resources to meet
revised spending plans.

Why are the funds available?
The funds are available due to salary lapse from approximately seven FTE positions that
have been vacant on and off during the first and second quarters of the fiscal year.
What hardships will the District face if the action is postponed until the subsequent
fiscal year?
If this reprogramming is not approved, the Office of the People’s Counsel will not be able
to cover the costs of items that have been critical in achieving the program goals and
objectives. As the agency has sufficient resources for the reprogramming, postponing
the actions to the subsequent fiscal year does not present a viable choice.
What programs, services, or other purchases will be delayed as a result of the
action and the impact on the program or agency?
Approval of this reprogramming will not adversely impact or delay any programs, services,
or purchases within the Office of the People’s Counsel’s FY 2023 budget.
