Pursuant to section 451 of the District of Columbia Home Rule Act (D.C. Official Code § 1-204.51) and
section 202 of the Procurement Practices Reform Act of 2010 (D.C. Official Code § 2-352.02), enclosed for
consideration and approval by the Council of the District of Columbia is proposed Human Care Agreement
(HCA) No. CW106884 with See Forever Foundation in the not-to-exceed amount of $3,272,517. The period
of performance is one year from the date of the award.
Under the proposed HCA, See Forever Foundation shall provide educational services at the Youth Services
Center to youth involved in the juvenile justice system who have been arrested and/or have been
unsuccessful under probation status.

A three percent increase over the base year has been anticipated in the compensation portion of the
option one period total price.

(C) The goods or services to be provided, the methods of delivering goods or services, and any
significant program changes reflected in the proposed contract:
The Department of Youth and Rehabilitation Services (DYRS) is the single District agency
responsible for the delivery of services to youth involved in the juvenile justice system, who
have been arrested and/or have been unsuccessful under probation status. Typically, these
youth have been identified as having varying degrees of emotional, behavioral, and psycho-
social problems. The youth have been court ordered into the temporary custody of DYRS
as wards of the District. DYRS serves committed male and female youth between the ages
of 12 and 21 or a portion of the age range.
The primary goal of the contractor's education program shall be to provide a quality education for
youth committed to the DYRS custody and care. The program shall be designed not only to raise
students’ scores as measured by assessments approved by the District of Columbia State Education
Agency, but more importantly, to increase the likelihood that students leaving the DYRS’ custody
and care will return to their communities and engage in productive activities to complete high school,
obtain and maintain employment, engage in post-secondary education, and/or obtain a General
Education Development Certificate.
See Forever Foundation will deliver an education program to youth who are in the custody of the
DYRS at the Youth Services Center secure facility, located at 1000 Mt Olivet RD NE, Washington,
DC 20002.
(D) The selection process, including the number of offerors, the evaluation criteria, and the
evaluation results, including price, technical or quality, and past performance components:
On November 04, 2021, the Office of Contracting and Procurement (OCP) on behalf of the
DYRS issued RFQ No:
Doc587431- “Educational Services-Youth Service Center” to deliver an education program to male
and female youth who are in committed/in custody status at the DYRS’ Youth Services Center, secure
facility for youth of the District of Columbia, with a closing date of December 07, 2021.
Three offerors submitted a Contractor Qualification Record. The selection of See Forever Foundation
was based on the evaluation criteria outlined in 27 DCMR Section 1905.6, “Selection of Human Care
Agreement Contractor”.

In accordance with 27 DCMR Section 1905.6, the contracting officer and the technical evaluation
panel reviewed and evaluated the offerors’ resumes, professional qualifications, relevant professional
and business licenses, capacity to accomplish the required work in the required time, experience with
similar scope of work, past performance, and other documentation submitted by the offerors. In
addition, the contracting officer determined the provider, See Forever Foundation, qualified as they
satisfied the requirements specified in the RFQ.
(E) A description of any bid protest related to the award of the contract, including whether the
protest was resolved through litigation, withdrawal of the protest by the protestor, or
voluntary corrective action by the District. Include the identity of the protestor, the grounds
alleged in the protest, and any deficiencies identified by the District as a result of the protest:
No bid protests have been filed.
(F) The background and qualifications of the proposed contractor, including its organization,
financial stability, personnel, and performance on past or current government or private
sector contracts with requirements similar to those of the proposed contract:
See Forever Foundation is licensed by the Middle States accreditation to provide educational
services. See Forever Foundation has the appropriate licenses, registrations, educational certificates
of compliance and staff credentials to provide the required services. See Forever Foundation has
satisfactorily provided services to the District for the past five years, and DYRS has rated their past
performance “very good”.
According to the company’s financial statement, the See Forever Foundation has adequate
financial resources to perform under their respective HCA. OCP deemed the See Forever
Foundation responsible.
(G) A summary of the subcontracting plan required under section 2346 of the Small, Local, and
Disadvantaged Business Enterprise Development and Assistance Act of 2005, as amended,
D.C. Official Code § 2-218.01 et seq. (“Act”), including a certification that the subcontracting
plan meets the minimum requirements of the Act and the dollar volume of the portion of the
contract to be subcontracted, expressed both in total dollars and as a percentage of the total
contract amount:
Department of Small Local Business Development approved a waiver with an adjusted small business
enterprise subcontracting requirement of five percent of the total contract value. The minimum value of
subcontracted services is $163,625.85, and the contractor proposes to subcontract $178,689.
(H) Performance standards and the expected outcome of the proposed contract:
The performance standards and expected outcome of the proposed contract include the delivery of
educational services to youth between the ages of twelve and twenty-one years old remanded from the
District Court System. See Forever Foundation shall perform a broad spectrum of developmentally
sound educational programs and services that are certified and/or licensed to meet the diverse, unique
educational needs of the committed and detained youth.

(I) The amount and date of any expenditure of funds by the District pursuant to the contract
prior to its submission to the Council for approval:
None
(J) A certification that the proposed contract is within the appropriated budget authority for the
agency for the fiscal year and is consistent with the financial plan and budget adopted in
accordance with D.C. Official Code §§ 47-392.01 and 47-392.02:
Per the Funding Certification, the agency’s Associate Chief Financial Officer certified that funds in
the required amount are available to fund the services.
(K) A certification that the contract is legally sufficient, including whether the proposed
contractor has any pending legal claims against the District:
The proposed definitized HCA has been reviewed for legal sufficiency by the Office of the
Attorney General and has been determined to be legally sufficient.
The proposed contractor does not have any currently pending legal claims against the District.
(L) A certification that Citywide Clean Hands database indicates that the proposed contractor is
current with its District taxes. If the Citywide Clean Hands Database indicates that the
proposed contractor is not current with its District taxes, either: (1) a certification that the
contractor has worked out and is current with a payment schedule approved by the District;
or (2) a certification that the contractor will be current with its District taxes after the District
recovers any outstanding debt as provided under D.C. Official Code § 2-353.01(b):
The Citywide Clean Hands database indicates the contractor is current with its District taxes, as of
April 18, 2023.
(M) A certification from the proposed contractor that it is current with its federal taxes, or has
worked out and is current with a payment schedule approved by the federal government:
Based on information contained in the Bidder Offeror certification form, See Forever Foundation
has certified that it is current with its federal taxes and does not have any outstanding debt to the
federal government.
(N) The status of the proposed contractor as a certified local, small, or disadvantaged business
enterprise as defined in the Small, Local, and Disadvantaged Business Enterprise
Development and Assistance Act of 2005, as amended; D.C. Official Code § 2-218.01 et seq.:
