204.51), enclosed for consideration and approval by the Council of the District of Columbia is
proposed Contract No. 2023-66 with Carl F. West LLC in the amountof$49,573,850.
Under the proposed contract, the District will loan $49,573,850 from the Housing Production Trust
Fund to Carl F. West LLC for the purpose of financing certain eligible acquisition costs,
predevelopment costs, soft costs, and construction hard costs for 179 units of affordable housing
located at 1370 Harvard Street, NW in Ward 1.

The Department of Housing and Community Development (DHCD) proposes to
provide a loan to Carl F. West LLC in the amount of $49,573,850 from the Housing
Production Trust Fund for the purpose of financing certain eligible predevelopment
costs, soft costs and construction hard costs associated with 179 affordable housing
units located at 1370 Harvard Street, NW in Ward 1.
(C) Results, including the price and technical components:
DHCD received a request for funding from the borrower to be used for the purpose of
financing certain eligible acquisition costs, predevelopment costs, soft costs and
construction hard associated with 179 affordable housing units located at 1370 Harvard
Street, NW in Ward 1.

(D) The background and qualifications of the proposed contractor, including its
organization, financial stability, personnel, and prior performance on contracts with
the District government:
The contractor is a newly formed entity specific to this project. The National Center and Caucus on
Black Aging Housing Development Corporation (NCBA HDC) is the developer and sponsoring
organization of the Carl F. West Estates project, alongside DMA Companies, Inc. NCBA is a
50l(c)(3) organization that has advocated for elderly minorities in the District since it was founded
in 1970, and currently provides employment programs, resources, and affordable housing
opportunities for seniors. The organization has held the Carl F. West site since it was originally
conveyed to NCBA by the District's Redevelopment Land Agency in 1979. Coakley & Williams
Construction, LLC will be the general contractor.
The development consultant and general contractor have satisfactory prior performance on
contracts with the District government.
(E) Performance standards and the expected outcome of the proposed contract:
The proposed DHCD loan proceeds will be used to provide a loan to Carl F. West LLC
in the amount of $49,573,850 from the Housing Production Trust Fund for the purpose
of financing certain eligible acquisition costs, predevelopment costs, construction costs,
and soft costs associated with the construction of 179 affordable housing units located at
13 70 Harvard Street, NW in Ward I.
The project is consistent with DHCD's goal of preserving and producing affordable
housing for low-to-moderate income residents. Additionally, the borrower is required to
fulfill all conditions as set forth in the loan agreement within the agreed upon time
frames. Failure to fulfill the terms of the loan agreement will constitute default.
(F) A certification that the proposed contract is within the appropriated budget authority
for the agency for the fiscal year and is consistent with the financial plan and budget
adopted in accordance with D.C. Official Code§§ 47-392.01 and 47-392.02:
The loan will be funded through the Housing Production Trust Fund. Attached is the
certification that the proposed loan agreement is consistent with the District's financial
plan and budget.
(G) A certification that the proposed contract is legally sufficient, including whether the
proposed contractor has any currently pending legal claims against the District:
A legal sufficiency memorandum from the Office of the General Counsel is attached.
(II) A certification that the proposed contractor is current with its District and federal
taxes or has worked out and is current with a payment schedule approved by the
District or federal government:

The proposed Loan is funded by Housing Production Trust Fund ("HPTF") program funds in an
amotmt not to exceed Forty-Nine Million Five Hundred Seventy-Three Thousand Eight Hundred
Fifty Dollars and Zero Cents ($49,573,850). The Loan proceeds will finance eligible expenses,
including acquisition costs, soft costs, construction hard costs, and cash collateralization oftax­
exempt bonds, related to the rehabilitation of One Hundred Seventy-Nine (179) tmits at the real
property located at 1370 Street NW, Washington, DC 20009 (the "Project"). One Hundred
Seventy-Nine (179) Project units shall be reserved as affordable housing units (the "Reserved
Units"), including units for seniors, people living with disabilities, grand families, and pem1anent
supportive housing. Forty-Three (43) of the Reserved Units shall be affordable to and occupied
by households ai or below 30% of Median Family Income (“MEP”); one hundred nineteen (119)
of the Reserved Units shall be affordable to and occupied by households at or below 50% of
MFI; and seventeen (17} ofthe Reserved Units shall be affordable to and occupied by
households at or below 80% of MEI. The Project affordability restrictions shall be enforced by
affordability covenants that run with the land in perpetwity.
The attached Loan Agreement evidencing the proposed contract has been prepared by the Office
ofthe General Counsel of the Department of Housing and Community Development and is
