To declare the existence of an emergency with respect to the need to approve Contract No.
GAGA-2020-T-0125, and Modification Nos. 5, 6, and 7 thereto, with CDW Government,
LLC to provide Microsoft software and associated support services to District of
Columbia Public Schools and approve payments for the goods and services received and
to be received under the modifications.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “Modification Nos. 1, 2, 3, 4, 5, 6, and 7 to Contract No. GAGA-
2020-T-0125 with CDW Government, LLC Approval and Payment Authorization Emergency
Declaration Resolution of 2023”.
Sec. 2. (a) There exists an immediate need to approve Contract No. GAGA-2020-T-
0125, Modification Nos. 5, 6, and 7 thereto with CDW Government, LLC, and Purchase Order
No. PO676913 to provide Microsoft software and associated support services to District of
Columbia Public Schools (“DCPS”) and to authorize payment for the goods and services
received and to be received under the modifications and purchase order.
(b) On December 9, 2020, the DCPS, Office of Contracts and Acquisitions, issued Task
Order No. GAGA-2020-T-0125 for a base year period amount of $840,095.03.
(c) By Modification No. 5, dated October 31, 2022, DCPS exercised part of Option Year
Two of Contract No. GAGA-2020-T-0125 for the period November 1, 2022 through February
28, 2023 in the not-to-exceed amount of $396,038.34.
(d) Modification No. 6 was an administrative modification.
(e) By Modification No. 7, dated April 5, 2023, DCPS exercised the remainder of Option
Year Two for the period March 1, 2023 through October 31, 2023 in the not-to-exceed amount of
$828,725.34, which increased the total not-to-exceed amount for Option Year Two to
$1,224,763.68. Purchase Order No. PO676913 reflects the not-to-exceed amount of
$1,224,763.68.
(f) Council approval is required under section 451(b) of the District of Columbia Home
Rule Act, approved December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51(b)(1)),
because these modifications increase the value of the contract to more than $1 million during a
12-month period.
(g) Approval is necessary to allow the continuation of these vital services.

Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute
emergency circumstances making it necessary that the Modification Nos. 1, 2, 3, 4, 5, 6, and 7 to
Contract No. GAGA-2020-T-0125 with CDW Government, LLC Approval and Payment
Authorization Emergency Act of 2023 be adopted after a single reading.
Sec. 4. This resolution shall take effect immediately.
