To declare the existence of an emergency with respect to the need to approve multiyear Contract
No. CW104923 with Phoenix Electric Sales, Inc. to provide electric school buses to the
Office of the State Superintendent of Education.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “Contract No. CW104923 with Phoenix Electric Sales, Inc.
Emergency Declaration Resolution of 2023”.
Sec. 2. (a) The Office of Contracting and Procurement, on behalf of the Office of the
State Superintendent of Education, proposes to enter into multiyear Contract No. CW104923
with Phoenix Electric Sales, Inc. to provide 10 electric school buses as part of the Environmental
Protection Agency’s 2022 Clean School Bus Rebate Program.
(b) The not-to-exceed price for the term of this multiyear contract with Phoenix Electric
Sales, Inc. is $3,681,490 for the 2-year period of performance.
(c) Approval is necessary to allow the District to receive the benefit of this vital service in
a timely manner from Phoenix Electric Sales, Inc.
(d) These critical services can only be obtained through an award of the multiyear
contract with Phoenix Electric Sales, Inc.
Sec 3. The Council determines that the circumstances enumerated in section 2 constitute
emergency circumstances making it necessary that the Contract No. CW104923 with Phoenix
Electric Sales, Inc. Emergency Approval Resolution of 2023 be adopted after on an emergency
basis.
Sec. 4. This resolution shall take effect immediately.
