Pursuant to section 451 of the District of Columbia Home Rule Act (D.C. Official Code 1-
204.51) and the Procurement Practices Reform Act (D.C. Official Code 2-351.01 et seq.),
enclosed for consideration and approval by the Council of the District of Columbia is proposed
Modification No. 12 to Contract No. DCKA-2018-C-0030 with Fort Myer Construction
Corporation to exercise option year three in the not-to-exceed amount of $80,000,000. The period
of performance is from June 3, 2022 through June 2, 2023.
Under the proposed modification, Fort Myer Construction Corporation shall continue to perform
local pavement restoration services throughout the District.

14. Description of Amendment/Modification (Organized by UCF Section headings, including solicitation/contract subject matter where feasible.)
1. The District hereby exercises option year three for the period June 3, 2022 through June 2, 2023 for a not-to-exceed
amount of $ 80,000,000, at the prices set forth in Section B.4 of the Contract, Price Schedule, for option year three. This
contract period is being incrementally funded, and the unexpended balance of any existing Purchase Order may be used
in this contract period, to the extent such funds are available for contract purposes.
2. In accordance with Section H.2 of the Contract, Department of Labor Wage Determinations, General Decision No.
DC20210001, Highway Construction Projects, District of Columbia, Mod. 3, effective March 4, 2022, is incorporated into
the Contract and will apply to Task Orders issued during option year three, is attached in place of the existing Attachment
J.1, and the Paving and Incidental Rates specified therein will apply to the extent applicable. The List of Attachments in
Section J is revised accordingly.
3. The Department of Employment Services (DOES) has announced that the Living Wage rate, currently set at $15.50 as
of January 1, 2022 (corresponding to the Districts Minimum Wage), will remain unchanged through June 30, 2022.
Additionally, the Department of Employment Services (DOES) has announced that the Living Wage rate will increase
July 1, 2022, and will be set at $16.10 (corresponding to the Districts Minimum Wage.) The attached 2022 Living Wage
Act Notice and Fact Sheet are incorporated into the Contract and attached as Attachments J.2 and J.3, respectively, in
place of the existing Attachments J.2 and J.3, and the List of Attachments in Section J is revised accordingly.
Except as provided herein, all terms and conditions of the document referenced in Item 10A remain unchanged and in full force and effect.
