Senate Bill No. 406 amends the existing law regarding the display of lighted lamps on bicycles, electric bicycles, and electric scooters when operated on public highways. The bill extends the requirement for these vehicles to display a lighted lamp from the current stipulation of a half-hour after sunset to a half-hour before sunrise, to instead require the lamp to be displayed from a half-hour before sunset to a half-hour after sunrise. Additionally, the bill maintains the requirement for the light to be displayed during conditions of insufficient light or unfavorable atmospheric conditions, as well as during precipitation such as snow, rain, or fog.
The bill also includes specific requirements for the visibility of the light emitted by the lamp, which must be visible from at least five hundred feet ahead, and mandates that each vehicle be equipped with a reflector or reflecting tail light lens visible from six hundred feet when illuminated by a motor vehicle's headlamps. Furthermore, it prohibits the use of sirens or devices that emit whistles on these vehicles. The bill is set to take effect on October 1, 2026, and violations of these provisions will be classified as infractions, which carry associated fines.
