Substitute House Bill No. 5312 establishes a civil action for individuals harmed by the unlawful dissemination of synthetically created intimate images, allowing them to seek damages and injunctive relief in the Superior Court. The bill defines "disseminate," "harm," and "synthetically created image" in accordance with existing statutes and specifies that individuals have two years from the discovery of the unlawful dissemination to file a civil action. The court may also protect the identity of the individual initiating the action and award costs and attorney fees to the prevailing party.
Additionally, the bill mandates that covered platforms create a process for individuals or the Attorney General to report and request the removal of unlawfully disseminated synthetically created intimate images. Upon receiving a valid request, platforms must remove the image within 48 hours and may face civil penalties for non-compliance. The bill also clarifies that acting in good faith to remove such images protects platforms from liability and does not limit individuals' rights to pursue other legal remedies. The provisions of this act will take effect on October 1, 2026.
