Substitute House Bill No. 7135 aims to strengthen the legal framework for reproductive and gender-affirming health care services in Connecticut. The bill introduces new definitions for "reproductive health care services," which now includes assisted reproduction, and "gender-affirming health care services," which covers medical care for gender dysphoria. It allows individuals to seek damages in Connecticut for legal actions taken against them in other states related to these services, regardless of their location at the time of service. The bill also enhances confidentiality protections by prohibiting covered entities and their business associates from disclosing patient information without explicit written consent, except in specified circumstances, and mandates that any subpoenas for patient information be reported to the Attorney General's office.

Additionally, the bill amends existing laws regarding the eligibility and disciplinary actions of health care providers, ensuring that the Department of Public Health cannot deny permits or licenses based on pending disciplinary actions from other jurisdictions if those actions pertain solely to reproductive or gender-affirming health care services that are legal in Connecticut. It repeals and replaces certain sections of the law, including Section 19a-567, to clarify that institutions cannot take adverse actions against providers based solely on their involvement in these services, provided they comply with state law. The bill also includes provisions to protect health care providers from adverse actions by insurers and clarifies that gender-affirming health care does not include practices aimed at altering sexual orientation or gender identity for minors. The legislation is set to take effect on July 1, 2025.
