Senate Bill No. 457, also known as Special Act No. 24-11, is an act concerning the reconveyance of a parcel of state land in the city of Middletown. The bill repeals Section 17 of public act 05-279 and substitutes new provisions effective July 1, 2024. The new provisions include the reconveyance of a parcel of land, approximately ten acres in size, which had previously been sold to the Shiloh Baptist Community Development Corporation and has since reverted to the state of Connecticut. The Commissioner of Administrative Services, rather than the Commissioner of Public Works, is now authorized to convey the parcel to the Shiloh Baptist Community Development Corporation at a cost equal to the administrative costs of the conveyance. The conveyance is subject to the approval of the State Properties Review Board, and the previous requirement for superior court approval for the removal of any restrictions on the state's conveyance of the land has been deleted.
The bill also sets a deadline of June 30, 2029, for the Shiloh Baptist Community Development Corporation to use the parcel for moderate-income housing and recreational or community facilities open to the public, with compliance to all nondiscrimination requirements. If by this date the land is not used for the development of such housing and facilities, or if at any time after the conveyance the housing or facilities do not comply with the nondiscrimination requirements, the land will revert to the state of Connecticut. The reverter provisions established by this act will replace and extinguish any prior reverter provisions recorded on the city of Middletown Land Records. Additionally, the State Properties Review Board must complete its review of the conveyance within thirty days after receiving a proposed agreement from the Department of Administrative Services, which will maintain care and control of the land until the conveyance is made. The State Treasurer is responsible for executing and delivering any necessary deed or instrument for the conveyance, which must include provisions to carry out the purposes of the act. The Commissioner of Administrative Services is assigned sole responsibility for all other aspects of the conveyance. The act was approved on June 5, 2024.
