Substitute Senate Bill No. 368, Public Act No. 24-7, is an act concerning source plasma donation centers. The bill amends Section 19a-565 of the 2024 supplement to the general statutes by repealing subsection (b) and substituting new provisions. The Department of Public Health is directed to adopt regulations for clinical laboratories, blood collection facilities, and source plasma donation centers. The new regulations will establish standards for exempt entities, operations, facilities, personnel qualifications, proficiency in testing, specimen collection, and other functions to ensure public health and safety. Notably, the bill removes the requirement for a registered nurse or advanced practice registered nurse to be onsite during the operation of these facilities and instead allows for a responsible physician, as defined in 21 CFR 630.3, to serve as the director. The Commissioner of Public Health must implement necessary policies and procedures by October 1, 2023, and update them by October 1, 2024, to be consistent with the new provisions.

Section 2 of the bill introduces a new provision effective from passage, which states that individuals performing apheresis on healthy donors for the purpose of collecting blood or blood components do not need to be licensed under chapter 378, provided they comply with federal and state regulations. The section defines "apheresis" as the process of drawing blood from a donor, separating it into components, retaining some, and returning the remainder to the donor. It also defines "donor" as a person who donates blood or blood components for therapeutic or manufacturing use or presents as a potential candidate for such donation. The act was approved on May 9, 2024.
