House Bill No. 5227, also known as Public Act No. 24-42, is an act concerning the release of certain liens held by the Department of Energy and Environmental Protection (DEEP). The bill amends Section 22a-5c of the general statutes by adding a new subsection (c). This new subsection provides a mechanism for individuals with an interest in real property that is subject to a lien, where the DEEP is the lienholder, to request the discharge of the lien. This applies to situations where the conditions for satisfaction of the lien have been met, but the discharge has not yet occurred.
The process established by the bill requires the interested person to send a written notice to the DEEP via registered or certified mail, with a return receipt requested, to ask for the lien to be discharged. The DEEP then has a maximum of sixty days after receiving the notice to release the lien. The release must be mailed back to the requester by certified mail, with a return receipt requested, and must meet the requirements set out in subsection (b) of section 52-380d. The release must also be sent to any municipality where the lien is recorded. The act is effective from the date of its passage.
