Substitute House Bill No. 5146, Public Act No. 24-84, is an act concerning the disclosure of financial records by financial institutions. The bill amends Section 36a-42 of the general statutes to specify conditions under which a financial institution may disclose a customer's financial records. These conditions include disclosures authorized by the customer, in response to a certificate signed by the Commissioner of Administrative Services or the Commissioner of Social Services (or any person deputized by either commissioner), lawful subpoenas, summons, warrants, court orders, interrogatories by a judgment creditor, demands by a levying officer, certificates issued by medical providers, requests by the Commissioner of Veterans Affairs, consents provided by elderly persons or their representatives, requests served in accordance with subsection (e) of section 12-162, and requests made by the Commissioner of Revenue Services. The bill inserts language that requires financial institutions to disclose financial records in response to a certificate signed by the Commissioner of Social Services (or any person deputized by the commissioner) within twenty calendar days of receiving such a certificate.
The bill also amends subsection (c) of section 36a-43 and section 36a-45 of the general statutes, effective October 1, 2024. It specifies that financial institutions must disclose financial records in accordance with the amended provisions of section 36a-42 or pursuant to an agreement with the IV-D agency. Additionally, the bill outlines penalties for officers or employees of financial institutions who knowingly and willfully furnish financial records in violation of the specified sections, as well as for any person who induces or attempts to induce such a violation. These offenses are classified as class C misdemeanors. The legal language deleted from current law includes the word "the" before the titles of the commissioners and the phrase "inclusive," which previously appeared after the list of sections in section 36a-45. The act was approved on May 30, 2024.
