Substitute House Bill No. 6718, Public Act No. 23-100, is an act concerning the safe storage and disposal of certain prescription drugs, illegal drugs, and cannabis products. The bill mandates that pharmacies post a sign informing consumers where to find information on the safe storage and disposal of unused and expired prescription drugs. It also introduces a new requirement for pharmacies to affix a fluorescent orange sticker or label with the warning "DANGER TO CHILDREN KEEP OUT OF REACH" in black ink to containers or packaging of opioid drugs or controlled substances in schedules II, III, IV, or V, starting January 1, 2024. The previous deadline of January 1, 2023, for pharmacies to post the consumer notification sign has been removed.
Additionally, the bill instructs the Commissioner of Consumer Protection to adopt regulations by July 1, 2024, providing guidance on the optimal size and font for the required stickers or labels, and to implement interim policies and procedures by September 1, 2023. Furthermore, the Department of Mental Health and Addiction Services is tasked with developing and administering a public awareness campaign by July 1, 2024, focusing on the safe storage and disposal of drugs, the risks they pose to children, and strategies to mitigate harm to children. This campaign is to be directed at individuals receiving substance use disorder treatment and those experiencing homelessness, and it must continue until at least June 30, 2026.
