Substitute Senate Bill No. 977, Public Act No. 23-94, is an act concerning medical assistance for surgery and medical services related to the treatment of obesity. The bill defines terms such as "bariatric surgery," "body mass index," "medical services," "severe obesity," and "obesity," with specific numerical values for body mass index to categorize obesity and severe obesity. It also specifies that medical services include prescription drugs approved for obesity treatment and nutritional counseling by a certified registered dietitian-nutritionist.
The bill mandates that the Commissioner of Social Services provide medical assistance for bariatric surgery and related medical services for Medicaid and HUSKY B beneficiaries with severe obesity, as well as medical services for those with a body mass index greater than thirty-five, provided they meet the conditions set by the Centers for Medicare and Medicaid Services for such surgery and services. The commissioner may need to amend the Medicaid state plan and the state plan for the Children's Health Insurance Program to implement the provisions of this section. The act is effective from July 1, 2023, and was approved on June 28, 2023.
