Existing law, the Merced County Flood Control District Act, establishes the Merced County Flood Control District to control the flood and stormwaters of the district, which consists of all the territory of the County of Merced.
This bill would require the district to coordinate its flood control planning and response operations with other local agencies located completely or partially in the County of Merced, including, but not limited to, cities and districts with responsibilities for surface water management or flood control. By imposing additional requirements on the Merced County Flood Control District, the bill would impose a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.
