Existing law, the Subdivision Map Act, vests the authority to regulate and control the design and improvement of subdivisions in the legislative body of a local agency and sets forth procedures governing the local agency's processing, approval, conditional approval or disapproval, and filing of tentative, final, and parcel maps, and the modification of those maps. The act requires prescribed security from a developer if the act or a local ordinance authorizes or requires the furnishing of security in connection with the performance of any act or agreement, including a requirement that specified forms of security be recorded with the county recorder of the county in which the subject real property is located.
This bill would state the intent of the Legislature to amend the act to prevent duplicative and unnecessarily burdensome requirements from being imposed on new housing regarding the furnishing of security in connection with the performance of subdivision-related improvements.
