The proposed bill would amend current statutes by adding a new section to Title 41, Chapter 49 of the Arizona Revised Statutes, which would change the chapter heading from "FEDERAL MONIES" to "FEDERAL MONIES AND FEDERAL RULE IMPLEMENTATION." It would require each state agency to create a dedicated webpage to post all guidance they create or receive from federal agencies, specifically if such guidance influences the agency's interpretation or implementation of state laws or provides compliance instructions. The bill mandates that this information be posted within 30 days and includes requirements for the content of the postings, such as the full text of the guidance, the date it was created or received, and a summary of its impact.
Additionally, the bill stipulates that if any guidance received from a federal agency is marked as confidential, the agency must post a notice explaining its existence and the reason for non-disclosure. It also clarifies that the posting requirements do not apply to personally identifiable information or sensitive security information. Furthermore, starting December 31, 2026, each state agency would be required to submit an annual report to legislative leaders regarding compliance with these posting requirements.
