This bill proposes to amend Title 44, Chapter 9 of the Arizona Revised Statutes by adding Article 27, which focuses on trade practices related to the pricing of covered goods. The new article introduces definitions for terms such as "actual damages," "covered goods," "covered retailer," "covered supplier," and "dominant covered retailer," among others. It establishes requirements for covered suppliers regarding the terms of sale they must extend to covered retailers and wholesalers, including the provision of anonymized sales data upon request. Additionally, it outlines conditions under which a covered supplier may not refuse to sell covered goods and sets forth the legal liabilities and defenses related to violations of this article.

The bill also stipulates that any act or practice in violation of this article constitutes an unlawful practice, allowing the Attorney General to investigate and take action. It grants the Attorney General or an injured party the right to file suit for injunctions and civil penalties, which can be up to three times the actual damages incurred. The new provisions aim to promote fairness in pricing practices for grocery items and ensure that all retailers have equitable access to terms of sale. The article will be officially titled the "Consumer Grocery Pricing Fairness Act" if enacted.
