It removes the deadline of December 31, 2007, for employers to verify employment eligibility through the e-verify program, thereby making this requirement ongoing. Additionally, it modifies the process for employers receiving economic development incentives by changing the timeline for repayment of funds upon a final determination of noncompliance from "of the final determination" to "after the final determination." The definition of "economic development incentive" is also expanded to clarify that it does not include tax provisions under titles 42 or 43.
Furthermore, the bill introduces new provisions that impose stricter penalties for employers who recklessly hire unauthorized aliens. For a first violation, courts may order termination of unauthorized employees, impose a three-year probation period with quarterly reporting, and require sworn affidavits confirming compliance. Subsequent violations could lead to the revocation of business licenses or permits, and the bill allows residents to petition the attorney general for enforcement actions against non-compliant employers. Additional protections are included for employers who terminate employees to comply with the law, ensuring they are not liable for claims if the terminations are made without discrimination.
