This bill proposes to amend current statutes regarding the appeals process for traffic violations. Under the existing law, a party may appeal a judgment from the court to the superior court, as outlined in
A. A party may appeal the judgment of the court. The appeal may be to the superior court in the same manner as provided by rules adopted by the supreme court. The new language would add that if the appeal is granted,
the court shall report the stay of enforcement of the judgment to the department. On receipt of the report, the department may not pursue any administrative action related to the judgment issued by the court until the stay is lifted or the judgment is affirmed by an appellate court.
This change aims to ensure that the Arizona Department of Transportation (ADOT) does not take any administrative actions regarding a traffic violation judgment while an appeal is pending, thereby providing a clearer process for individuals contesting traffic violations. The bill would become effective on the general effective date, as stated in the provisions.
