This bill proposes several updates to current statutes regarding the right to work in Arizona. It would repeal
section 23-1302, which currently addresses violations related to labor organization nonmembership. The article heading of title 23, chapter 8, article 1 would be changed from
"RIGHT TO WORK" to
"GENERAL PROVISIONS". Additionally, the language surrounding liability for violations would be modified, clarifying that a person who violates provisions is liable and may be sued for such acts, while also ensuring that labor organizations are bound by the actions of their authorized agents.
Furthermore, the bill would clarify that the employment relationship is severable at the discretion of either party unless a written contract specifies otherwise, while maintaining that this does not affect the rights of public employees under Arizona law. It would also remove references to the exercise of free choice regarding nonmembership in a labor organization, which is currently protected by
section 23-1302. Lastly, the act would not take effect unless the Arizona Constitution is amended by a public vote to support the changes related to the right to work.
