This bill proposes to amend current statutes by adding a new section that allows assisted living homes and centers to offer mild hyperbaric oxygen therapy (HBOT) to residents. The new provisions specify that the therapy must be conducted using a Class II mild hyperbaric oxygen chamber that has received FDA premarket notification clearance for home use, and it must be prescribed by or used under the direction of a physician. Additionally, residents must be able to independently extricate themselves from the chamber.

The bill also outlines several requirements for assisted living facilities that provide HBOT. These include ensuring that the therapy is only administered on a physician's order, having a trained staff member present during treatments, and providing residents with a notice detailing the FDA approval status of the device, potential risks, and recommendations for consulting their treating physician. Furthermore, the bill prohibits offering HBOT to residents requiring directed care services unless there is a physician's order and informed consent from the resident or their representative. Lastly, it grants the Department of Health Services the authority to adopt necessary rules for the implementation of these provisions.
