This bill proposes to amend current statutes by adding a new section, 23-207, to title 23, chapter 2, article 1 of the Arizona Revised Statutes, which focuses on employment practices related to pregnant employees. Under the new law, employers with fifteen or more employees would be required to provide reasonable accommodations for pregnant employees unless doing so would cause undue hardship to the business. The bill outlines specific accommodations that may include modifications to equipment, additional break periods, assistance with manual labor, a private area for breastfeeding, flexible work schedules, and scheduling for prenatal health care visits.
Additionally, the bill stipulates that employers cannot require employees to use their annual, vacation, or sick leave if a reasonable accommodation can be made. Employers would also be mandated to post notices regarding this requirement and include the information in employee handbooks. Written notice must be provided to newly hired employees at the time of hire, to current employees within 180 days of the law's effective date, and to pregnant employees within ten days of notification of their pregnancy. This act would be known as the "Pregnant Workers Protection Act."
