This bill proposes updates to the Arizona Residential Landlord and Tenant Act by amending section 33-1368. It retains the current provisions regarding tenant noncompliance affecting health and safety, but clarifies that the list of actions constituting a material and irreparable breach is not exhaustive. Additionally, it modifies the process for reinstating rental agreements after nonpayment, specifying that reinstatement is contingent upon the tenant paying all past due rent, reasonable late fees, attorney fees, and court costs after a special detainer action is filed.
Furthermore, the bill introduces new provisions for tenants who have maintained a tenancy of twelve months or more. It stipulates that landlords can only terminate or refuse to renew a rental agreement under specific circumstances, such as nonpayment of rent or material breaches of the rental agreement. In cases where the landlord or their family intends to reside in the rental property or if the property is removed from the rental market, the landlord is required to waive one month of the tenant's rent or provide one month's rent as relocation assistance.
