The proposed bill, if enacted, would amend current statutes by adding a new section (13-721) to title 13, chapter 7 of the Arizona Revised Statutes. This new section would establish that individuals aged eighteen or older, or tried as adults, convicted of felonies against vulnerable adults or incapacitated persons would not be eligible for sentence suspension, probation, pardon, or early release, except under specific conditions outlined in existing law.
Additionally, the bill would increase the sentencing ranges for certain felony offenses. Specifically, it would raise the presumptive, minimum, and maximum sentences by three years for class 4, 5, or 6 felonies, and by five years for class 2 or 3 felonies. This increase would be in addition to any other applicable enhanced sentences, thereby strengthening the penalties for crimes committed against vulnerable populations.
