The proposed bill would update current statutes by introducing the Arizona Immigration, Cooperation and Enforcement Act (Arizona ICE Act), which mandates cooperation between state and local agencies and federal immigration authorities. It would allow for the establishment of memorandums of agreement (MOAs) for immigration law enforcement, preempting local policies that restrict such cooperation. Law enforcement agencies (LEAs) would be required to comply with immigration detainer requests from U.S. Immigration and Customs Enforcement (ICE) and follow specific procedures for handling detainees, including notifying judges and documenting detainer information. The definition of LEAs would be expanded to include municipal police departments and the Department of Public Safety (DPS).

Additionally, the bill would require correctional facilities to enter agreements with ICE for the temporary housing of individuals under immigration detainers, while ensuring costs are covered. It would remove the appropriation from the state General Fund for FY 2026 intended for county sheriff's offices and the Arizona Department of Corrections, Rehabilitation and Reentry (ADCRR) to administer the Arizona ICE Act. The bill would also eliminate the requirement for local education agencies (LEAs) to support federal immigration law enforcement and would grant the Attorney General the authority to investigate compliance with these provisions, allowing taxpayers to request enforcement actions if necessary.
