If enacted, this bill would introduce the "Second Amendment Financial Privacy Act," which would amend current statutes to prohibit government entities from maintaining any records of privately owned firearms or their owners, except in the context of criminal investigations or as required by law. Additionally, it would prevent payment card networks from using merchant category codes that distinguish firearm retailers from other retailers, thereby ensuring that such retailers are treated the same as other businesses in financial transactions.

The bill would also grant exclusive enforcement authority to the Attorney General or county attorneys, requiring them to investigate alleged violations and issue written notices to violators. If violations are not addressed within 30 business days, the Attorney General or county attorney would be empowered to seek injunctions and civil penalties of up to $1,000 for each violation. The bill includes definitions for key terms such as "firearm retailer," "merchant category code," and "covered entity," and establishes that the remedies provided are exclusive to violations of this section.
