This bill proposes to amend current statutes regarding the location of nonprofit medical marijuana dispensaries and cultivation sites. Under the new law,
nonprofit medical marijuana dispensaries and cultivation sites would be prohibited from being located within 500 feet of a child care facility or a facility that provides preschool programs. Additionally,
localities would be barred from enacting any ordinances or rules that permit marijuana establishments to be situated within 500 feet of public schools, private schools, child care facilities, or preschool programs.
The bill also clarifies that these location restrictions apply only to
nonprofit medical marijuana dispensary registration certificates and marijuana establishment licenses issued after the general effective date of the act. Furthermore, it requires that the enactment of these provisions receive an affirmative vote of at least three-fourths of the members of each house of the legislature, as stipulated in
Proposition 105. Overall, the bill aims to enhance the regulatory framework surrounding medical marijuana dispensaries in relation to child care and educational facilities.
