The proposed bill would update section 36-2859 of the Arizona Revised Statutes by introducing specific advertising restrictions for marijuana and marijuana-related products.
Currently, the law allows marijuana establishments and nonprofit medical marijuana dispensaries to engage in advertising but does not specify the types of advertising restrictions. The new provisions
would prohibit advertising to individuals under twenty-one years of age, including the use of appealing names, images, and mediums. It would also prohibit advertising in public transportation areas and require that electronic advertisements target an audience that is at least 73.6% over the age of twenty-one.
Additionally, the bill
mandates that all advertising must include a conspicuous warning about the risks of marijuana use for individuals under twenty-one and pregnant women, establishes penalties for non-compliance, and clarifies that advertising does not include communications targeted solely to an established customer base or those requested by customers with age verification. The changes would take effect after June 30, 2026, and require a three-fourths affirmative vote from the legislature to be enacted.
