SB1613 amends Arizona Revised Statutes section 13-3884 to expand the circumstances under which a private person may make an arrest. The bill allows a private person to arrest someone who, in their presence, has committed a theft of property from a retail store. This is in addition to the existing law that permits private arrests for misdemeanors amounting to a breach of the peace or felonies committed in the private person's presence, as well as for felonies where the private person has reasonable grounds to believe the individual committed the crime.

The bill also includes technical changes and removes a previous modification to the theft statute that classified the theft of any property or services valued at less than $2,000 as a class 6 felony. The bill becomes effective on the general effective date.
