SB1364 is a bill that amends Arizona Revised Statutes relating to probation. It introduces a process for the courtesy transfer of a probationer's intensive probation supervision or supervised probation to another county within the state if the probationer intends to reside there and can provide proof of family caregiver obligations, employment or housing, or an offer of employment or housing that will aid in their positive behavioral change. The supervising probation department is required to confirm the details of the probationer's plans, review any victim safety concerns in compliance with the victims' bill of rights, and submit the transfer request to the receiving county within seven business days.
The receiving probation department must verify the information from the sending department and grant permission for the transfer within seven business days unless the plan is found to be not factual or the transfer would endanger the victim. If a probationer violates the terms of probation or commits an additional offense while on probation after the transfer, the probation department in the county where the violation or offense occurred may not return the probationer to the original county except for revocation hearings or by court order. The bill also makes technical changes and specifies that probationers must submit a written transfer request.
