The bill SB1374 amends Arizona Revised Statutes by adding sections 16-407.04 and 16-407.05, which pertain to the conduct of elections. It requires any person, other than a government entity, to provide a certification to the Secretary of State (SOS) that they are not knowingly receiving foreign donations, directly or indirectly, before entering into any agreement to provide money, goods, or services related to election administration. This certification must be updated annually and within five business days if new information is discovered. Failure to provide an accurate certification is classified as a class 1 misdemeanor and invalidates any agreement with government entities for election administration.
The bill also empowers the Attorney General to file actions for violations, including seeking injunctions and damages of at least $5,000 per violation. Qualified electors and state officers can initiate civil actions to enforce the provisions, with courts able to award injunctive relief, daily damages for noncompliance, and cover costs and attorney fees for prevailing claimants. The SOS is tasked with maintaining records of certifications, posting them online, and requiring quarterly reports from government entities on persons providing election-related services. The bill's remedies and penalties are in addition to other legal provisions.
