The bill SB1345 proposes the continuation of the Arizona Power Authority (APA) until July 1, 2032, with a repeal of the relevant section (41-3024.16) of the Arizona Revised Statutes and the addition of a new section (41-3032.16). The APA will terminate on January 1, 2033, unless it still has outstanding contractual obligations with the United States or any U.S. agency, debts or obligations related to the Boulder Canyon Project, or has not made satisfactory provisions to pay or retire these debts or obligations. If such debts or obligations exist without satisfactory provisions for their retirement, the APA will continue to exist until they are fully satisfied.
The bill also includes a provision that allows the APA to continue bargaining for, taking, and receiving electrical or other forms of energy to benefit the state of Arizona. The bill's provisions are set to apply retroactively from July 1, 2024.
