HB2609 amends Arizona Revised Statutes related to the Automobile Theft Authority (ATA). The bill entitles insurers who have overpaid the fee for each motor vehicle under a motor vehicle liability insurance policy to a refund of the overpaid amount. Insurers must submit a written request for a refund to the ATA within one year of the due date of the overpaid assessment, along with satisfactory documentation to substantiate the overpaid amount. The Director of the Department of Insurance and Financial Institutions (DIFI) is required to approve or deny the refund request and, if approved, refund the amount from the ATA Fund.
Additionally, the Director is authorized to audit insurers for compliance with fee collection requirements, with the expenses of such audits to be paid by the insurer. Claims initiated by an insurer in 2023 can be approved by the Director until December 31, 2024, provided the insurer includes satisfactory documentation of the overpaid amount. The bill makes conforming changes and is set to become effective on the general effective date.
