HB 2485 proposes amendments to Arizona Revised Statutes section 13-1604, expanding the scope of aggravated criminal damage to include acts that interfere with or prevent the normal function of utility infrastructure or property, or the intended course or path of any utility service. The bill maintains the classification of the offense as a class 3 felony if damages amount to $10,000 or more, a class 4 felony if damages are between $1,500 and $10,000, and a class 5 felony for all other cases.
Additionally, the bill specifies that the cost of the loss of the utility service should be considered when determining the amount of damage to property for the purposes of aggravated criminal damage. This is in addition to the existing considerations such as the cost of repair or replacement, loss of crops and livestock, reasonable labor and material costs, and costs attributed to equipment used to repair the damage. Technical changes are also made to the statute.
