HB2374 introduces the offense of "aggravated unlawful flight from a pursuing law enforcement vehicle" as a class 2 felony. This offense applies when a person commits unlawful flight and either drives at least 35 miles per hour over the speed limit during the pursuit or causes serious physical injury or death to another person during the pursuit. The bill also adds this new offense to the list of offenses in the felony murder statute and to the statute allowing a peace officer to remove a vehicle under certain circumstances.

Additionally, the bill lowers the sentencing classification for the unlawful flight provision involving watercraft from a class 5 felony to a class 1 misdemeanor. It also makes technical and conforming changes to the Arizona Revised Statutes, including amendments to sections 5-391, 13-1105, 28-622.01, and 28-4834, and adds section 28-622.02.
