For drivers of vehicles for hire and transportation network company drivers, a BAC of 0.04 or more will not give rise to the usual presumptions used in DUI cases. Instead, this BAC level will be considered a violation of the new DUI threshold specifically for these drivers. Additionally, the bill requires that information provided during implied consent DUI tests and administrative license suspension reports include the 0.04 BAC threshold applicable to these drivers.
