The proposed bill amends title 13, chapter 31 of the Arizona Revised Statutes by adding section 13-3123, which pertains to the sale and transfer of firearms. Under the new legislation, private sales or transfers of firearms must be facilitated by a licensed firearms dealer. The dealer is responsible for retaining possession of the firearm, conducting background checks on the purchaser or transferee, and ensuring all legal requirements are met before completing the sale or transfer. If the dealer cannot legally transfer the firearm to the purchaser or return it to the seller, the firearm must be handed over to law enforcement within 24 hours. Dealers may charge a fee of up to $20 for facilitating the transfer.

The bill outlines several exemptions to this requirement, including transfers involving law enforcement, military personnel, gunsmiths, common carriers, and temporary loans for target shooting or hunting under specific conditions. It also exempts the transfer of antique firearms, bona fide gifts between immediate family members, and temporary transfers necessary to prevent imminent death or great bodily harm, provided the recipient is legally allowed to possess a firearm. Violation of this section would be classified as a class 5 felony.
