HB2143 is a bill that amends the Arizona Revised Statutes relating to the reuse of gray water. The bill allows the Arizona Department of Environmental Quality (ADEQ) to establish rules for residential gray water treatment systems used indoors for toilet flushing, addressing public health or safety concerns. Until such rules are established, the bill permits the use of residential gray water for toilet flushing if the system uses less than 400 gallons per day, is certified to meet specific standards, precludes human contact with gray water, provides a dedicated piping system, and functions properly.

The bill also expands the prohibition on cities, towns, or counties from limiting the use of gray water, not just when it is allowed by an ADEQ-issued permit, unless it would reduce the volume of effluent available for assured water supply requirements in certain areas. Any residential gray water treatment system installed after the effective date of the ADEQ rules must meet the minimum requirements established by those rules.
