This bill amends Arkansas Code Title 16, Chapter 92, Subchapter 1, to establish a new section, 16-92-107, which mandates the refund of costs and fees paid by defendants in criminal cases under specific circumstances. The term "mandated costs and fees" is defined to include various expenses incurred by the defendant during prosecution, such as court filing fees, service fees, ignition interlock device costs, pretrial supervision fees, and ankle monitor fees.

According to the new provisions, any mandated costs and fees paid by a defendant must be refunded if the defendant is acquitted, if the charges are dismissed, or if an order of nolle prosequi is entered. In cases where a defendant is acquitted of some charges but convicted of others, only the costs associated with the acquitted or dismissed charges will be refunded. This legislation aims to ensure that defendants are not financially penalized for charges that do not result in a conviction.
