The proposed legislation, known as the "Good Neighbor Act," aims to clarify the liability and immunity associated with food donations in Arkansas. It repeals the existing Arkansas Code 20-57-103, which previously outlined the liability of donors of canned, live, or perishable food. The new section, Arkansas Code 20-57-105, introduces definitions related to food donations, including terms such as "food," "food product," and "gleaner." It establishes that individuals or organizations donating food that does not meet consumer safety standards or is not readily marketable are not subject to civil or criminal liability, provided they make the donation in good faith and inform the recipient organization of the food's condition.

Additionally, the act specifies that churches, religious organizations, and nonprofit organizations distributing donated food are also protected from liability under similar conditions. However, the act maintains that liability may still arise from gross negligence, recklessness, or intentional misconduct. Furthermore, it mandates that all licensed food producers or distributors in the state be notified of the liability and immunity provisions established by this act.
