The bill amends the Revised Arkansas Anatomical Gift Act to allow specific classes of individuals to modify, amend, or revoke an anatomical gift after the donor's death. New provisions specify that a donor's anatomical gift can be altered by an agent with a durable power of attorney for health care prior to the donor's death. After the donor's death, the right to modify or revoke the gift is granted to the donor's spouse, children, parents, siblings, grandparents, grandchildren, guardian, or other next of kin, in that order. Additionally, the bill mandates that organ procurement organizations submit annual reports to the Legislative Council detailing the number and types of organs and tissues procured, the organizations they supplied, and financial information related to the procurement. It also requires reporting on instances of anatomical gift revocation. Failure to comply with these reporting requirements can result in the revocation of the organization's charter by the Secretary of State, barring them from future organ procurement activities in Arkansas.
